DC-26-00003254 – Notice of Decision, Emergency Assistance application 10000305517

Send the statutory decision letter on Emergency Assistance application 10000305517 immediately, and no later than October 28, 2026 at 5:00 PM.

It must state:

1. the determination, as subsection 56 (3) of O. Reg. 134/98 requires;

2. the reasons for it, as the City's own Emergency Assistance Decision Letter template and its case worker training on Directive 2.3 require;

3. my right to request an internal review within 30 days under subsection 69 (1) of O. Reg. 134/98, as Appendix A of the City's operating document CSSD/ESS/OSU 03/2025 requires.

I decline any discussion; this matter proceeds in writing only.

Take notice that issuing a delayed decision does not cure the City's prior bad faith, nor does it render the judicial review (DC-26-00003254) moot. I will not withdraw the application, and I will not waive my claim for substantial indemnity costs.

Govern yourself accordingly.

RE: [number]

Dear DANILO DZYUBAN:

I am writing to you about your application for financial assistance for Ontario Works Emergency Assistance.

You submitted a request for Emergency Assistance on July 29th, 2026. We reviewed your request and it was determined on July 30th, 2026 that you did not qualify for Emergency Assistance.

You do not qualify because:

- Emergency Assistance is considered "basic financial assistance" pursuant to Section 5 of the Ontario Works Act, 1997 (the "Act").
- It had been determined in the Decision letter dated June 18th, 2026 (the "Notice of Decision") that you were not eligible for financial assistance under the Act because:
- We do not have enough information to decide if you qualify for Ontario Works. This is because we did not receive the information we asked for.
- You do not have the immigration status to qualify for Ontario Works financial assistance. For example, you cannot receive Ontario Works if you are: An Ineligible Refugee Claimant; Only visiting Canada and have not applied for permanent residence.
- Further to your request for an Internal review of the Notice of Decision, it was further determined in the Internal Review Decision dated July 30, 2026 that you did not qualify because:
- You do not have the immigration status to qualify for Ontario Works financial assistance. You cannot receive Ontario Works if you are: Here as a temporary resident on a work permit and have not applied for permanent residence.

Based on the Notice of Decision, and the Internal Review Decision dated July 30, 2026 it was determined that you were not, at the time you made the request for emergency assistance, eligible for assistance under the Act.

As such, a review of the conditions set out in Section 56 of Ontario Regulation 134/98: General for when Emergency Assistance may be provided and the amount of emergency assistance payable was not undertaken.

If you do not agree with our decision

If you do not agree with a decision in this letter, you can ask us to review it. This is called an internal review.

You must ask for an internal review in writing by November 30, 2026. If you miss this deadline but you still want to ask for an internal review, you should write to us explaining why you were late. If you do not ask for an internal review, this decision will be final.

We have included additional information about how to ask for an internal review and appeal a decision with this letter. Please note that while you can request an internal review of this decision, decisions respecting emergency assistance cannot be appealed to the Social Benefits Tribunal. (Section 26(2) of the Act).
