Human Rights Legal Support Centre - written service conditioned on disclosure of a Code ground - record for the Ombudsman file and for the Attorney General - Danilo Dzyuban

Hello,

Danilo Dzyuban. This letter delivers the full written record of the service the Human Rights Legal Support Centre gave an applicant before the Human Rights Tribunal of Ontario. It goes to the Ombudsman of Ontario, for the file open with your office on my Ontario Works matter, and to the Attorney General, as the minister responsible for the Centre under Part IV.1 of the Human Rights Code. The thread of 17 August to 25 September 2026 is below in full.

The record stands as follows.

1. On 17 August 2026 the Centre asked me to telephone. I answered in writing the same day and asked 3 questions.
2. On 25 August 2026, after 8 days, the Centre answered in writing and offered written intake only "where a client is unable to communicate over the telephone for Human Rights Code-related reasons".
3. On 1 September 2026 the Centre wrote: "If someone does not have a Code-related reason for needing communication in writing, they will be expected to use our telephone intake to access our legal services." In the same message: "We do not provide the names of our Human Rights Advisors".
4. On 24 September 2026 I required, within 12 days, the written policy behind each of those 2 positions, with its date of adoption and the name and position of the person who approved it, and a written statement on each of my 2 intakes, I-2026-006521 and I-2026-006601.
5. On 25 September 2026 the Centre answered: "The Centre's internal protocol regarding requests for names of intake staff is not available to the public" and "We are currently not representing you on any particular file." It produced neither policy, named no approver and gave no decision on either intake.

The Centre wrote to me on 25 August, 1 September and 25 September 2026. It communicates in writing when it chooses to. It withholds that channel from an applicant who does not disclose a Code ground, such as a disability, to obtain it. Sections 45.12 and 45.13 of the Human Rights Code set out the Centre's objects and its services, and none of them is conditional on speech or on the disclosure of a personal characteristic. Throughout this period I was self-represented in 4 applications before the Tribunal: 2026-68457-I, 2026-68461-I, 2026-68772-I and 2026-68783-I.

For the Ombudsman of Ontario:
Add this record to my open file.
Confirm in writing by 31 October 2026 whether your office takes up the Centre's refusal of written service. If your office holds that the Centre falls outside its jurisdiction, name the provision of the Ombudsman Act on which it relies.

For the Attorney General:
Produce in writing by 31 October 2026 (1) whether the Ministry approved, or was informed of, a Centre policy that conditions written service on the disclosure of a Code ground, and on what date; (2) the memorandum of understanding or accountability agreement under which the Ministry funds the Centre.

This record and every answer to it go into the 4 Tribunal files above as the record of the legal support that was available to the applicant.

This exchange goes into the public record at https://dzyuban.com/legal/record/

Respectfully,

Danilo Dzyuban
