SBT file 2608-06747 - Interim Assistance Order of 21 August 2026 not complied with - shelter unpaid for August to October 2026 - Danilo Dzyuban
Hello,
Danilo Dzyuban, SBT file 2608-06747. A copy goes to the Director, Social Assistance Intake Unit, under Rule 5.8.
On 21 August 2026 the Tribunal directed the Director to pay interim assistance from 1 August 2026 to 31 January 2027 under section 30 of the Ontario Works Act, 1997. The order states: "Only the SBT can cancel or vary this decision for interim assistance."
That order is not complied with. My shelter cost at CCI Ottawa, 1754 St. Joseph Boulevard, is $390 a month. For August, September and October 2026 the respondent paid basic needs only, and the shelter amount of $1,170 is unpaid.
On 7 October 2026 I required the City of Ottawa in MyBenefits to pay that amount within 7 days, and on 10 October 2026 the same text went by email to the caseworker, Jean-Pierre Kunstenaar. Nothing is paid and no written answer has come.
Instead, the City sets an intake meeting, a first point of contact and a telephone call in front of the payment. On 7 October 2026 the caseworker passed his request for a call through my housing provider. The order sets no such condition. On 6 October 2026 I required the City to send the action plan in writing so that I sign it in writing, and it has sent none. Every document the City sends gets my answer in writing, through MyBenefits.
My letter to the Tribunal of 29 September 2026 is unanswered.
The Tribunal is to:
(1) Direct the respondent to pay the $1,170 by 23 October 2026 and state the payment date in writing.
(2) Direct the respondent to pay basic needs and shelter for November 2026 to January 2027 on the regular date of each month.
(3) Confirm in writing that the order has no condition of an intake meeting or a telephone call, and that only a decision of the Tribunal may reduce or stop the interim assistance.
(4) State in writing the step the Tribunal takes when a respondent does not pay under its order.
Answer by 23 October 2026. After that date the non-compliance goes to the Divisional Court under the Judicial Review Procedure Act and to the Ombudsman of Ontario.
