Service of the Notice of Application on the City of Ottawa - Divisional Court File DC-26-00003254-0000 - Danilo Dzyuban
Hello,
The City of Ottawa and its Administrator of Ontario Works are the respondents in Divisional Court File No. DC-26-00003254-0000. The court issued the attached Notice of Application on 22 September 2026.
29 SEPTEMBER 2026, 110 LAURIER AVENUE WEST.
At 3:20 p.m. I attended at City Hall with 2 copies of the issued Notice of Application. Clause 16.02 (1) (b) of the Rules of Civil Procedure names who receives service on a municipal corporation. They are the mayor, the clerk, the deputy clerk and a lawyer for the municipality. City Hall produced none of them.
The third floor, where Legal Services is located, was closed to the public. Ground-floor security sent me to the security office, and that office sent me to the Service Ottawa counter. I told the counter clerk that I needed a certification of service of a court document. The clerk did not understand the request and sent me to the courthouse. Then the clerk stated a fee of $60 and told me to sit and wait. Receiving service of a court document carries no fee. I waited until an attendant called me by name, and at 3:44 p.m. she stated that she could not sign. Asked who could, she gave no clear answer. I left with both copies unserved.
No one at City Hall named the person who receives court documents for the City.
WHAT IS REQUIRED.
1. Have a lawyer for the City accept service of the attached Notice for both respondents under subrule 16.03 (2).
2. Return the endorsed and dated copy to this address by 5 October 2026.
3. State who receives court documents at 110 Laurier Avenue West, on which floor and at what hours.
4. State what the fee of $60 was for, and name the by-law that sets it.
5. Name the lawyer who acts for the respondents in this file. After 5 October 2026 a motion goes to the Divisional Court under rules 16.04 and 16.08. It seeks an order validating service and costs against the City. The record of 29 September 2026 goes into the affidavit.
Respectfully,
Danilo Dzyuban
