Notice of claim for damages under section 18 of the Crown Liability and Proceedings Act, 2019 - Danilo Dzyuban - Ontario Works

Hello,

This is a notice of claim served on the Crown under section 18 (1) of the Crown Liability and Proceedings Act, 2019.

Defendant: His Majesty the King in right of Ontario, for the acts of the Ministry of Children, Community and Social Services, the Director and the Social Assistance Intake Unit, 621 Main Street West, North Bay.

THE OCCASION

1. On 5 June 2026 the claimant applied for Ontario Works, application SA26-UFZ-688-121-295.

2. On 18 June 2026 the Social Assistance Intake Unit refused the application. On 15 July 2026 it refused a second application, SA26-QOV-111-975-045.

3. On 7 July 2026 the claimant requested an internal review of the first refusal. The decision of 30 July 2026 kept the refusal, replaced its ground and named no paragraph of section 6 (1) of Ontario Regulation 134/98.

4. On 28 July 2026 the claimant requested an internal review of the second refusal. The Ministry issued no decision on it. On 17 August 2026 its Intake Unit answered through MyBenefits by pointing to the letter of 30 July 2026, which decides the request of 7 July 2026.

5. On 21 August 2026 the Social Benefits Tribunal, in file 2608-06747, ordered the Director to pay interim assistance from 1 August 2026 to 31 January 2027. The first payment reached the claimant on 3 September 2026.

6. On 2 September 2026 the Social Assistance Intake Unit decided in writing: "your application for financial assistance from Ontario Works has been approved as of June 5, 2026". For 89 days the Ministry withheld assistance on an application that its own decision declares valid from the day it was made.

7. The payment of 3 September 2026 is $1,326.27 and consists of basic needs alone. Shelter allowance paid from 5 June 2026 to this day: $0.

8. On 23 September 2026 the City of Ottawa, for the Ontario Works Administrator, put the file on hold and assistance stopped. The Tribunal has delivered no decision that cancels or varies its order of 21 August 2026.

THE CLAIM

The claim is for general, special, aggravated and punitive damages and for damages under section 24 (1) of the Canadian Charter of Rights and Freedoms. The causes of action are negligence in the administration of the file, misfeasance in public office, and breach of sections 7 and 15 of the Charter. The amount is stated in the claim.

WHAT THE CROWN DOES NOW

(1) Confirm service of this notice in writing and state the date of service.

(2) State in writing whether the Crown waives the leave requirement under section 17 (11) of the Act.

(3) Preserve every record on: the entries and notes in the Social Assistance Management System, the MyBenefits logs, and the correspondence between the Ministry and the City of Ottawa.

Answer by 13 October 2026. The 60 days of section 18 (1) run from service, and the claim is issued in the Superior Court of Justice when they end.

Danilo Dzyuban
