Access to Information request with fee waiver — Sport Canada funding conditions, female category eligibility
Hello,
This is a request under the Access to Information Act, together with a request for a waiver of the application fee under subsection 11(2).
The records requested concern the conditions attached to federal funding of national sport organisations in respect of eligibility for the female category.
DESCRIPTION OF RECORDS REQUESTED
1. Every funding condition, policy requirement, or contribution agreement clause imposed by Sport Canada on a national sport organisation concerning eligibility for participation in the female category, in force at any time from 1 January 2020 to the date of this request.
2. Every record identifying the legal authority for the conditions identified in item 1, including any statute, regulation, Order in Council, or ministerial direction.
3. All correspondence between Sport Canada and any national sport organisation concerning eligibility for the female category, from 1 January 2020 to the date of this request.
4. Every record setting out the effect on funding where a national sport organisation adopts eligibility rules for the female category based on sex at birth, including any assessment of whether such rules place funding at risk.
5. Every record of correspondence between Canadian Heritage and the Government of Alberta concerning the Fairness and Safety in Sport Act, and every internal analysis of that Act prepared by the Department.
6. Every record of correspondence with World Athletics, World Aquatics, or the International Olympic Committee concerning eligibility for the female category, from 1 January 2022 to the date of this request.
7. Every record setting out performance indicators, targets, and measured results for federal programmes concerning gender in sport, including any Performance Information Profile prepared under the Treasury Board Policy on Results, and the measured results reported against each indicator.
8. Every record setting out the number of complaints, appeals or safe-sport files received concerning eligibility for the female category, from 1 January 2020 to the date of this request, in aggregate form.
FEE WAIVER
A waiver of the application fee is requested under subsection 11(2) of the Access to Information Act, which empowers the head of a government institution to waive or refund the fee.
The requester is an applicant for social assistance. The Social Benefits Tribunal issued an interim assistance order on 21 August 2026 in file 2608-06747 directing payment from 1 August 2026. The Director has not complied with that order and no payment has been made. The requester is without means to pay the fee.
A decision on this waiver request is required in writing. A refusal will be referred to the Office of the Information Commissioner of Canada as a barrier to access.
