Re: HRTO File 2026-68772-I, Dzyuban v. Google LLC and Google Canada Corporation: Request for Order (Form 10), Request for Interim Remedy (Form 16) to preserve the account; Statement of Delivery (Form 23)
Hello,
HRTO File 2026-68772-I. This letter is copied to Google LLC at both of its addresses on file (Rule 1.12).
On 10 October 2026 the Applicant filed and delivered a Request for an Interim Remedy (Form 16) under Rule 23. It asks for an order that the Respondents preserve the Google Account [email] and its records until the Application is decided. Rule 23.4 gives a responding party 7 days to respond. That time ended on 17 October 2026. The Respondents filed no response and delivered none.
The account remains open to deletion under the Respondents' own inactivity policy. Every day without the order is a day on which the records the Application asks the Tribunal to order produced can be lost for good.
The Applicant's letters of 10 October 2026 asked the Tribunal, within 6 days, to confirm receipt of the filing and to state how the Application was sent to Google Canada Corporation. 9 days later, no confirmation has come.
The Applicant asks the Tribunal to:
1. Decide the Request for an Interim Remedy in writing, on the record before it, without a response from the Respondents.
2. Confirm in writing that the filing of 10 October 2026 (Form 10, Form 16 and Form 23) is on the file.
3. State how and on what date the Application and both Requests were sent to Google Canada Corporation.
The Applicant asks for the confirmation in items 2 and 3 by 26 October 2026. Absent an answer, the delay goes to the Executive Chair of Tribunals Ontario.
This exchange goes into the public record at https://dzyuban.com/legal/record/
Respectfully,
Danilo Dzyuban
