Re: Re: COMP-01407916-PF - Notice of Extension Request CCTS:[number]

Hello,

The CCTS wrote on 5 October 2026 that Freedom Mobile requested the extension on 23 September 2026, that the CCTS accepted it at its discretion, and that the objection documents contain proprietary information and cannot be shared.

THE EXTENSION.

Section 19.1 of the Procedural Code gives the discretion and binds it in the same sentence: the Commissioner shall exercise it so that a change of time does not operate unfairly to the Customer or to the Participating Service Provider. A discretion bound by a test of fairness is exercised on a ground. The CCTS has given the date of the request and no ground.

THE OBJECTION.

Section 6.7 of the Procedural Code requires the Participating Service Provider to reply to the Commissioner in writing, with a copy to the Customer. Under paragraph 6.7(a) an objection is a full written explanation, including the specifics of the objection. Under subparagraph 6.7(a)(i) the Commissioner decides the objection after the representations of the Customer. A Customer who has not seen the objection cannot make representations on it.

Section 15.3 allows non-disclosure only on the request of the party that supplied the document, only in good faith, and only where non-disclosure does not unduly impede the investigation. Section 15.4 then requires the Commissioner to offer that party a choice: withdraw the document from consideration, or withdraw the request for non-disclosure. The Procedural Code contains no rule that withholds an objection from the Customer because it is proprietary.

WHAT I REQUIRE, BY 15 OCTOBER 2026.
1. The reason Freedom Mobile gave for the extension, and the ground on which the CCTS found under section 19.1 that the extension causes no unfairness to me.
2. The copy of the objection that section 6.7 requires Freedom Mobile to give me.
3. If Freedom Mobile asked for non-disclosure under section 15.3, the date of that request and the choice the CCTS offered it under section 15.4. In every case, the specifics of the objection, so that I can answer them.
4. The date on which the objections team will decide, and confirmation that it will not decide before it receives my representations on the objection.

If 15 October 2026 passes without these answers, the handling of this file goes to the Commissioner and Chief Executive Officer of the CCTS and to the CRTC.

This exchange goes into the public record at https://dzyuban.com/legal/record/
