Re: Avis d’enquête en vertu de l’article 32 modifié - Amended notice of intention to investigate under section 32 - 5826-03149

Hello,

Danilo Dzyuban, complaint 5826-03149. Three points on the amended notice of 23 September 2026.

The access request number in the notice is wrong. A-2026-00370 belongs to a different request, received by ESDC on 2 September 2026 and concerning the federal response to the fertility rate. The request under this complaint was sent on 28 July 2026 at 20:14 UTC and concerns ESDC funding of NPower Canada under the Youth Employment and Skills Strategy. It has no file number, because ESDC has never registered it. Issue a corrected notice and send me a copy.

ESDC wrote to me on 23 September 2026 at 14:32 UTC, 20 minutes after the amended notice was issued. The message, signed by Matthew Schneider, Junior ATIP Officer, offers mail as a method of submission for the first time, 57 days after the request, and states: "Your cheque or money order is payable to the Receiver General for Canada." I hold a Visa Debit card and nothing else. The portal refuses debit cards and the mail route requires a cheque. The institution has replaced one closed door with another, and that is the conduct under subsection 4(2.1) that the Commissioner is investigating. The message ends: "please resend the attachment from the original email. We no longer have access to it." The institution states that it no longer holds a record relating to the allegation, 2 days after the notice under section 32 required it to keep every such record. I ask the investigator to obtain from ESDC the date the attachment was lost, the officer responsible and the disposal authority.

The fee remains unpaid because ESDC has named no method open to me and has not decided the waiver applied for on 28 July 2026 under subsection 11(2). That is the reason the allegation closed on 17 September 2026 was called premature, and it is the same failure. I ask that the finding on that allegation be revisited when the investigation establishes the facts above.

I resent the attachment to ESDC today and required registration, the waiver decision and a method of payment by 30 September 2026. Copies of both messages are available to the investigator on request.

Respectfully,

Danilo Dzyuban
