Request under the Access to Information Act — records concerning the guidance of 18 May 2022 on products of plant breeding

Hello,

I make this request under section 6 of the Access to Information Act. I am a Canadian resident and I request access to the following records held by Health Canada.

1. All correspondence between Health Canada and CropLife Canada, Seeds Canada, the Canada Grains Council, or any other industry association, concerning the novelty interpretation of products of plant breeding, dated between 1 January 2021 and 18 May 2022.

2. All records of meetings, including agendas, minutes, presentation decks and attendance lists, held between Health Canada officials and those associations on the same subject and in the same period.

3. All legal opinions, legal risk assessments, and internal analyses held by Health Canada that address the authority of the department to alter the application of Division 28 of Part B of the Food and Drug Regulations by guidance, dated between 1 January 2021 and the date this request is processed.

4. All records showing the number of submissions received under the Transparency Initiative for gene-edited foods since 18 May 2022, including any internal tally, tracking sheet or reporting document.

5. All records assessing the effect of voluntary labelling on consumers who follow religious or medical dietary restrictions, dated between 1 January 2021 and the date this request is processed.

I request the records in electronic format.

Fees. I am without income and I am unable to pay the application fee. I request a waiver of the fee under subsection 11(6) of the Access to Information Act. The records sought concern the safety and labelling of food sold to every resident of Canada, and the public benefit of their release is direct. If the waiver is refused, I ask to be advised in writing of the refusal, the reason for it, and the method of payment, and I will pay the 5.00 dollar fee.

I require registration of this request on the date of its receipt. Where the department holds no record answering any numbered item above, I require a written statement to that effect for that item.

A refusal to register this request until a fee is paid, an absence of a file number, or an absence of a decision on the waiver request will be placed before the Information Commissioner of Canada.

Respectfully,

Danilo Dzyuban
